Ibiza’s Biggest-Ever Planning Fine: Santa Eulària Collects €1.78 Million Over Illegal Renovation

Santa Eulària has collected €1.78 million from a single urban-planning enforcement case — the largest sanction of its kind in the municipality’s history. The case concerns an extensive renovation carried out without the required municipal licence at a property near the Ca na Palava industrial estate.

The final amount paid by the property owner reached €1,778,663.17, after the debt entered enforcement proceedings and accumulated surcharges, late-payment interest and costs.

What Happened at the Property?

The case dates back to a major renovation of a house with more than 400 square metres of built area spread across two floors.

According to Santa Eulària Town Hall, the works included:

• A comprehensive renovation of the property
• Renovation of the roof and installations
• The conversion of a 54.68-square-metre garage into an installation room
• The renovation and enlargement of an existing annex
• Works whose estimated overall value exceeded €544,000

The authorities determined that the scale of the works went far beyond the minor interventions that had initially been communicated to the municipality.

The Property Had Additional Protection

One of the most important details in the case is the age of the house.

The property dates from before 1956, meaning it falls under heritage protection provisions established through Ibiza's Island Territorial Plan (PTI).

According to Santa Eulària, this protected status was an important factor in determining the severity and eventual size of the sanction because the works carried out were not permitted on a property subject to this protection.

This helps explain why the eventual penalty was dramatically higher than the estimated €544,000 value of the construction works.

The Works Continued Despite Stop Orders

The case was not simply about carrying out construction without the appropriate licence.

Municipal technical inspectors found that the works continued on several occasions despite provisional orders requiring them to stop.

That became another important element of the proceedings and contributed to the eventual classification of the offences.

The authorities ultimately identified three urban-planning offences: one classified as very serious and two as serious.

Together, the scale of the renovation, the property's protected status and the continuation of works despite stop orders resulted in the exceptionally high sanction.

Santa Eulària Has Collected More Than €5.2 Million in 2026

The €1.78 million case is also part of a much larger enforcement picture.

Between January 1 and August 20, 2026, Santa Eulària Town Hall says it had collected and closed enforcement cases worth a combined €5,225,190.93.

That figure includes other enforcement proceedings and is not solely related to urban-planning penalties.

For comparison, during the whole of 2025, the municipality collected and closed enforcement cases totalling €7,527,860.10.

The municipality also stresses that these figures refer to cases fully collected and closed through enforcement proceedings, and do not include partial payments on cases where money remains outstanding.

A Warning for Ibiza’s Construction Boom

The timing is significant.

Ibiza continues to experience intense investment in residential properties, renovations and luxury homes, while local authorities are under increasing pressure to ensure development remains within planning and heritage rules.

Santa Eulària's record case demonstrates that the financial consequences of ignoring those rules can be enormous.

In this particular case, a renovation estimated at more than €544,000 ultimately resulted in a payment of almost €1.78 million once the sanction, enforcement surcharge, interest and costs were included.

For property owners across Ibiza, it is a powerful reminder that planning permission, heritage protection and compliance with municipal stop orders are not optional details when undertaking major works.
