Ibiza Estate Agency Alleges Tenants Sublet €36,000 Annual Rental to Tourists Throughout Summer

October 13, 2026

An estate agency in Ibiza has alleged that a group of Italian tenants sublet a newly built apartment in Platja d’en Bossa to tourists throughout the summer, despite having signed an annual rental agreement worth €36,000.

According to the agency, the contract was arranged in March at €3,000 per month, with the full year's rent paid in advance. The company says it later gathered evidence suggesting that the property was being used for tourist accommodation and submitted complaints to the Consell d’Eivissa and Ibiza Town Council.

The allegations were reported on 12 October. At the time of publication, the agency said it had not received the inspection response it was seeking. The reported claims have not been established as a final administrative or judicial finding.

A Year-Long Rental in Platja d’en Bossa

The property is described as a newly built, three-bedroom apartment in Platja d’en Bossa, equipped with access to a gym and swimming pool.

The estate agency said the tenants initially appeared financially reliable and suitable for a long-term rental. The agreed rent was €3,000 per month, amounting to €36,000 over 12 months.

However, the agency said suspicions arose early in the summer that the apartment was being used to accommodate short-stay visitors rather than solely for the agreed residential rental.

According to an employee quoted in the report, staff encountered people staying in the apartment on 6 August who said they were on holiday. The agency interpreted this as evidence that the property was being sublet to tourists.

Agency Says It Collected Evidence and Filed Complaints

The agency says it gathered photographs showing different vehicles entering and leaving the building's garage on different dates. It also referred to complaints from neighbours about noise in the residential block.

The company subsequently submitted complaints to the Consell d’Eivissa and Ibiza Town Council, seeking an investigation into the suspected tourist use of the apartment.

The agency expressed frustration at what it described as a lack of action. It said it had been told that enforcement could be difficult without an active advertisement on platforms such as Airbnb or Booking.com.

These statements reflect the agency's account of its dealings with the authorities. The available reporting does not independently establish the complete status of the complaints, whether an inspection was subsequently carried out, or whether the tenants have been formally sanctioned.

Dispute Over the Rental Agreement

The agency also described unsuccessful attempts to resolve the matter directly with the tenants.

According to the company, the tenants had paid the annual rent in advance but later sought the return of money for months during which they would not be staying in the apartment.

The agency alleged that the tenants had already profited from the property's use during the summer. That allegation has not been independently verified, and the available report does not establish the amount of any income earned through subletting.

The disagreement highlights the potential complications that can arise when a property rented under a long-term agreement is suspected of being used for short-term tourist accommodation.

Illegal Tourist Rentals Remain an Enforcement Issue in Ibiza

The allegations come amid continued enforcement against suspected illegal tourist accommodation in Ibiza.

On 9 October, the Local Police of Ibiza, working with inspectors from the island council, inspected 49 apartments in a residential building near Avenida 8 de Agosto. Authorities reported sealing one property over suspected illegal tourist rental activity, issuing four infringement reports and recording another for obstruction of the inspection.

That enforcement action was separate from the dispute involving the Platja d’en Bossa apartment and does not establish the validity of the estate agency's allegations.

The outcome of the complaints concerning the €36,000 annual rental remains unclear in the information available. Any determination of illegal subletting or administrative liability would depend on the relevant evidence and the authorities' investigation.
