The Policía Local de Ibiza has intervened in what authorities describe as a new form of home-delivery sales involving nicotine vape devices, seizing 33 products during a nighttime operation in Ibiza Town.

The intervention took place on Sunday night, September 13, when officers from the Unidad Nocturna Operativa were carrying out preventative security work and attending another service at a property on Calle Campanitx.

Officers Encountered a Person Waiting for a Customer

According to the police account, officers noticed a person waiting outside the building after leaving the property. The person's behaviour attracted their attention, and during the subsequent conversation the individual said they were waiting for a customer and were involved in the sale of vaping devices.

Officers then found 33 nicotine vape devices, all in sealed boxes, together with a card-payment terminal intended to process the sales.

No Licence or Company Documentation Presented at the Time

The police asked the person to provide the licence or authorisation required to carry out the activity, as well as documentation relating to the company for which the individual said they worked.

According to the Ayuntamiento de Ibiza and the Policía Local, that documentation could not be provided at the time of the intervention. The officers subsequently carried out the corresponding administrative procedures to establish what had happened and determine whether any responsibilities arose.

The authorities have not announced a final administrative decision establishing an infringement in this particular case.

Company Disputes the Police Interpretation

The company linked to the seized products has since challenged the official interpretation of the incident.

Its legal representative said the business has the necessary licences and documentation in force and argued that the person stopped by police was not carrying out an unauthorised street sale. According to the company's version, he was waiting for his brother to bring him an order that had already been placed by a customer.

The representative also said that, after visiting the Policía Local the following day, he was told that the matter involved an act of seizure rather than a formal complaint, and that the company intended to request the return of the devices.

Dispute Over How the Sale Should Be Classified

The disagreement centres partly on how the transaction should be classified under Spanish and Balearic commercial rules.

The company's representative argues that nicotine vaping devices are legally distinct from tobacco products under the relevant legislation and that a pre-arranged delivery to a customer should not automatically be treated as street vending.

Balearic commercial legislation does distinguish between different forms of commercial activity, including door-to-door sales and non-sedentary or street sales. However, the existence of those categories does not by itself determine whether the specific activity detected on Calle Campanitx complied with all applicable requirements.

The 33 Devices Remain at the Centre of the Case

For now, the 33 nicotine vape devices are the principal items involved in the police intervention.

The products were found in sealed packaging and accompanied by a payment terminal, which police say was intended for customer transactions. The authorities have said that their administrative investigation is aimed at clarifying the circumstances and determining any possible legal responsibility.

There has been no indication that the person was accused of selling the products to minors in this particular incident.

A Different Way of Selling Vape Products in Ibiza

What has attracted particular attention is the method of sale described by police.

Rather than operating from a conventional shop, the person was allegedly arranging a transaction at a residential location and was reportedly waiting for a customer. The presence of a payment terminal and multiple sealed devices led officers to investigate the activity as a commercial operation.

The Ayuntamiento de Ibiza said the intervention demonstrates the role of nighttime police patrols in detecting activities that may otherwise be difficult to identify during routine inspections.

Authorities Say Controls Will Continue

Ibiza Town Hall said it intends to continue strengthening controls aimed at ensuring commercial activities comply with the relevant authorisations and regulations.

The municipality said these actions are intended to protect consumers and public health and to prevent commercial activities from operating outside established controls.

At the same time, the company's challenge means the legal status of the particular transaction remains disputed.

What Is Confirmed So Far

Police confirmed the seizure of 33 nicotine vape devices and a payment terminal during the September 13 intervention. They also confirmed that the person involved was unable to provide the requested authorisation and company documentation at that moment, prompting administrative proceedings.

The company, however, says it has the necessary documentation and disputes the police interpretation of the applicable rules.

The case therefore remains an administrative matter under review, rather than a confirmed finding that the company or the individual committed an offence.
