Formentera Beach Kiosks Face Possible Loss of Concession as Cancellation Procedure Continues

October 23, 2026

The future of Formentera’s eight beach kiosks remains uncertain as the Balearic Islands Government’s procedure to potentially terminate the concession continues to cast a shadow over the island’s beach services.

The case centres on alleged breaches of the concession conditions, particularly the obligation to dismantle the installations during the designated winter period. The procedure was initiated by the regional government after technical reports identified possible failures to comply with essential requirements governing the seasonal and removable nature of the kiosks.

The opening of the procedure does not mean the concession has already been cancelled. A final administrative decision is still required, and the Consell Insular de Formentera has challenged the case.

Why the concession is under scrutiny

The concession granted in 2023 covers eight beach kiosks and two sailing schools. It allows the kiosks to occupy public maritime-terrestrial land under specific conditions, including a requirement to dismantle the installations between 15 January and 15 February.

Technical reports prepared by the regional government’s coastal authorities identified alleged breaches of essential concession conditions. These included the failure to dismantle installations during the required period, concerns about whether certain structures were genuinely removable and questions relating to the authorised location and extent of some facilities.

The regional government initiated the cancellation procedure after examining these issues. The case concerns compliance with the concession as granted, rather than simply whether the kiosks provide a service during the tourist season.

The Consell de Formentera contests cancellation

The island council has rejected the possibility of losing the concession and submitted formal allegations opposing its cancellation.

In a statement published on 5 February 2026, the Consell said it had complied with the essential conditions of the concession granted in April 2023. It argued that there was no sufficient legal basis or proportionate justification for withdrawing it, citing an independent legal report in support of its position.

The council’s position contrasts with the concerns raised by the regional government’s technical services. Those concerns remain allegations within an administrative procedure and should not be presented as a final finding that the concession has been forfeited.

A dispute over the winter dismantling requirement

The obligation to dismantle the kiosks during winter has been a central point of disagreement.

The Consell previously sought to modify the concession conditions to remove the dismantling requirement. The regional government rejected that request in a decision signed at the end of December 2025, leaving the original obligations in place.

The dispute continued into 2026. In January, the island council indicated that it would submit arguments seeking to have the cancellation procedure archived. It also acknowledged that the outcome remained uncertain.

The original concession conditions therefore remained at the heart of the disagreement, with the council seeking to defend the existing arrangement and the regional government examining whether the alleged breaches justified termination.

The kiosks continued operating during the 2026 season

Despite the uncertainty surrounding the concession, the beach kiosks began operating for the 2026 tourist season while the administrative dispute remained unresolved.

In August, former concession holders said they would consider taking legal action if the regional government did not move to declare the current concession expired. They argued that the alleged breaches had been documented and questioned why the kiosks could continue operating while the procedure remained unresolved.

Those statements represent the position of the former concession holders, who are parties to the wider dispute. They do not establish that the current concession has been cancelled or that a court has ruled in their favour.

What happens next?

The key question is whether the Balearic Islands Government will ultimately declare the concession expired or close the procedure without cancellation.

If the concession were terminated, the Consell could lose the legal basis for managing the beach services under the existing arrangement, potentially requiring a new administrative process to obtain the relevant authorisations and award new operating rights.

For now, the dispute remains a matter of administrative and legal process. The kiosks’ future depends on the final decisions taken by the competent authorities, rather than on the mere opening of the cancellation procedure.
