Swiss Man Receives Suspended Prison Sentence After Admitting to Raping Woman in Ibiza

October 15, 2026

A Swiss man has received a suspended prison sentence of just under two years after admitting to raping a young Swiss woman at a rented property in Sant Antoni, Ibiza, in September 2019.

The conviction was handed down by the Balearic Islands Provincial Court on 13 October 2026. Under the agreement reached with the prosecution, the man must also pay the woman €30,000 in compensation and is prohibited from contacting her for five years.

The sentence means he will not serve the prison term immediately, subject to the conditions of the suspension.

Assault Followed an Evening Out in Ibiza

The incident took place on 27 September 2019. According to the prosecution’s account, the man had been visiting an Ibiza nightclub with three friends when they met a group of young Swiss women.

The group later went to the rented accommodation in Sant Antoni where the man and his friends were staying. During the night, the man and the woman kissed and touched each other consensually.

At around 07:00 the following morning, he suggested going to a treehouse on the property to watch the sunrise.

The prosecution said that, once there, he touched the woman intimately and penetrated her with his fingers despite her saying no and attempting to move his hand away. When she tried to leave, he allegedly pulled down her leggings and penetrated her with his penis three times, despite her clearly expressing that she did not consent and wanted to leave.

The woman eventually managed to get away and return to the others. The case also described the psychological harm she suffered.

Consent to earlier kissing or touching did not constitute consent to the subsequent sexual acts.

Prosecution Had Sought Five Years in Prison

Before the case was resolved, prosecutors had requested a five-year prison sentence and €50,000 in compensation for the victim’s psychological harm and other damages.

The defendant had spent two years in provisional detention before being released after paying €30,000 bail.

The final outcome was a suspended prison sentence of just under two years, following an agreement with the prosecution. The compensation awarded was €30,000, and the court imposed a five-year prohibition on contacting the woman.

Suspended Sentence Means No Immediate Prison Term

The case has drawn attention because the defendant admitted the offence but did not receive an immediate custodial sentence.

A suspended sentence is distinct from an acquittal: the conviction remains, while the prison term is not served immediately under the terms of the suspension. The exact conditions governing the suspension were not detailed in the reporting reviewed.

The outcome brings the criminal proceedings over the 2019 assault to a conclusion, with the sentence, compensation and no-contact measure forming the penalties reported by the court coverage.
