A man has been sentenced to two years in prison and fined €8,000 after being convicted of preparing and selling MDMA and ketamine from his home in Ibiza.

The sentence was handed down by the Provincial Court of the Balearic Islands on September 15, 2026. The defendant accepted the charges brought by the Public Prosecutor's Office in a case involving drug trafficking from a private residence in Ibiza.

The court suspended the execution of the two-year prison sentence for three years, meaning he will not enter prison immediately provided he does not commit another offence during the suspension period.

Police Raid on Ibiza Home

The case originated from a search of the man's home carried out by agents from the UDYCO on September 28, 2022.

According to the facts established in the judgment, officers found equipment and materials consistent with the preparation and distribution of drugs, including a precision scale, several resealable plastic bags and €60 that was determined to have come from sales to third parties.

The investigation subsequently established that the activity involved the preparation and sale of narcotic substances from the property.

Around 333 Grams of MDMA and Ketamine Seized

The search resulted in the seizure of six plastic bags containing pink-coloured tablets and powder.

Laboratory analysis found MDMA in the seized material, with several of the samples also containing ketamine. The individual bags contained quantities ranging from approximately 2.4 grams to 302.88 grams, with measured concentrations ranging from 7% to 66%.

Taken together, the seized material weighed around 333 grams. The judgment placed its estimated illicit-market value at €15,471.21.

The court also ordered the confiscation of the money and drugs, with any remaining substances to be destroyed.

Prison Sentence Suspended for Three Years

Although the court imposed a two-year prison sentence, the defendant will not serve that sentence immediately.

The Provincial Court granted a three-year suspension of the execution of the prison sentence under Article 80 of Spain's Penal Code. The principal condition is that he does not commit another offence during the suspension period.

The court took into account that he had no previous criminal record and that the sentence did not exceed two years. The Public Prosecutor's Office supported the suspension, and the defendant agreed to it.

He was also ordered to pay the legal costs.

Case Resolved Without a Trial

The proceedings were concluded through a plea agreement, meaning there was no full oral trial.

Both the prosecution and the defence accepted the facts, the legal classification of the offence and the agreed sentence. The judgment also applied a highly qualified mitigating circumstance for undue delays in the proceedings, taking into account the time that had passed since the investigation began.

The court declared the judgment final at the same hearing after neither side indicated an intention to appeal.

The court ordered the confiscation of the seized substances and the €60 found during the search. Any drugs that had not already been destroyed were ordered to be destroyed.
