Ibiza's restrictions on late-night alcohol sales are facing questions over enforcement after a UK newspaper investigation reported that its journalist was able to purchase alcoholic drinks from several shops in Sant Antoni after the legal sales cut-off.

The Balearic Islands' tourism legislation prohibits commercial establishments in the designated Sant Antoni area from selling alcoholic drinks between 21:30 and 08:00. The same rules prohibit the consumption of alcohol in public spaces within the affected area, except on authorised terraces and other legally permitted areas.

The rules remain in force under the Balearic Government's tourism-responsibility legislation.

What the Law Says

The restriction is broader than simply requiring shops to hide alcohol from customers.

The Balearic Government clarified in 2024 that the relevant provision means commercial establishments in the affected areas must close between 21:30 and 08:00, rather than merely closing their alcohol displays.

Sant Antoni is one of the municipalities covered by the regulation. The designated area of the town has remained within the scope of the measures introduced under the regional legislation.

The current framework is scheduled to remain in force until December 31, 2027.

Reporter Buys Alcohol After the Cut-Off

The investigation, published on September 26, reported that a journalist was able to purchase alcoholic drinks from six different shops in Sant Antoni after 23:00.

The purchases reportedly included spirits, miniature bottles, canned alcoholic drinks and other products.

The investigation described the transactions as taking place around the town's main nightlife area, including locations close to the bar-lined Strip and venues in the vicinity of Eden, Ibiza Rocks and O Beach.

These observations indicate apparent instances in which businesses were selling alcohol during hours when such sales are prohibited.

They do not, on their own, establish the overall level of compliance among businesses across Sant Antoni or demonstrate that enforcement has failed throughout the municipality.

Public Drinking Is Also Restricted

The rules also cover consumption rather than only sales.

Under the regional legislation, drinking alcohol in public areas within the designated zones is prohibited, with exceptions for terraces and other legally authorised areas.

The penalty for breaching the public-consumption prohibition is between €500 and €1,500.

That means a visitor purchasing alcohol from a shop outside the permitted hours could face a separate issue from the shop itself if the drink is then consumed in a prohibited public space.

Bars and Restaurants Can Continue Serving

The restrictions do not amount to a general prohibition on drinking alcohol at night in Sant Antoni.

Bars, restaurants and other authorised hospitality venues can continue serving alcohol within their permitted operating conditions.

The restriction specifically targets the sale of alcohol through commercial establishments covered by the regulation and public consumption in the designated areas.

This distinction is important because visitors can legally purchase and consume drinks at authorised hospitality venues after 21:30.

The Balearic Government introduced the measures as part of its wider legislation aimed at improving tourism-responsibility standards in specific areas affected by excessive tourism-related behaviour.

The 2024 amendments increased the focus on public alcohol consumption and clarified how the commercial restrictions should operate. The Government also stated that the measures were intended to improve inspection, security and awareness in the affected tourist areas.

The regional government has said enforcement would be carried out through the relevant authorities.

The reported purchases in Sant Antoni demonstrate that breaches can still occur, but determining the effectiveness of the rules requires official enforcement data, including inspections, sanctions and confirmed violations.

The report also described encounters with people offering illegal drugs and nitrous oxide during a walk through the nightlife area.

The reported ability of one journalist to purchase alcohol from several businesses after the cut-off raises questions about compliance and enforcement at those particular premises.

Whether this represents a wider enforcement problem would require official inspection and sanction data.
