New Boat Rental Rules Now in Force in Ibiza and Formentera: Licence Required to Take the Helm

New rules governing recreational boat rentals came into force on October 1, 2026, changing one of the most accessible forms of boating in Ibiza and Formentera.
People renting a recreational boat and intending to operate it themselves must now hold a navigation licence or the appropriate nautical qualification for the vessel and type of navigation. The change particularly affects the small motorboats that could previously be rented without a licence under certain conditions.
The new requirement follows a change to Spain's recreational boating regulations through Royal Decree 1188/2025.
What has changed from October 1?
Until September 30, certain motorboats of up to five metres in length and a maximum nominal power of 15 CV could be operated without a nautical qualification, provided they were used during daylight hours and stayed within two nautical miles of the departure port, marina or beach.
That exemption has now been narrowed.
The new rules reserve the no-qualification exception for private use and certain sporting activities. When the boat is being operated under a rental agreement, the person at the helm must have the appropriate licence or qualification.
This means the familiar Ibiza and Formentera model of renting a small motorboat and taking it out independently without any boating qualification is no longer permitted.
What does this mean for people renting a boat?
For visitors planning to rent a boat without a skipper, the most important change is that they now need to demonstrate that they are properly qualified to operate the vessel.
The qualification must be appropriate for the boat and the intended navigation.
One option is the Licencia de Navegación, which provides basic authorisation to operate recreational vessels within its permitted limits. Other nautical qualifications may also apply depending on the characteristics of the boat and the planned navigation.
For anyone who does not hold the required qualification, the alternative is to rent the boat with a qualified skipper who will be responsible for operating the vessel.
Boat rental companies must verify the qualification
The new rules also place an important responsibility on charter companies.
Companies renting recreational boats must check that the person who will operate the vessel has the required qualification and retain the relevant information so it can be demonstrated during an administrative inspection.
This applies to foreign visitors as well as Spanish customers. A foreign qualification must also provide the appropriate authorisation for the vessel and navigation concerned.
For businesses in Ibiza and Formentera, this means checking qualifications as part of the rental process rather than simply relying on the size and power of the boat.
Private boat owners are not affected in the same way
The change does not eliminate the general private-use exemption.
A person using their own recreational motorboat can still operate a vessel of up to five metres and 15 CV without a nautical qualification, provided the conditions established by the regulations are met.
The exemption also covers sporting use of sailing boats up to six metres and certain floating or beach craft.
The relevant conditions include being at least 18 years old, operating during daylight and remaining within two nautical miles of the departure port, marina or beach.
Motos náuticas are excluded from this general exemption and continue to be governed by their specific regulations.
Why has the rule changed?
The Spanish Government's Royal Decree states that the reform responds to the number of incidents and accidents associated with recreational boat rental activities.
The new framework therefore distinguishes between private use and commercial rental. The exemption for small boats remains available in defined private and sporting circumstances, while people taking control of a rented vessel must now demonstrate the required level of training.
The Captaincy of the Merchant Marine for Ibiza and Formentera has also stressed the importance of verifying qualifications as part of the rental process.
What are the options for visitors?
For visitors coming to Ibiza or Formentera, the practical choices are now straightforward:

Rent a boat and operate it yourself if you hold the appropriate navigation licence or qualification.

Obtain the relevant qualification before renting and operating the boat.

Rent a boat with a qualified skipper if you do not have the required qualification.

Use a private boat under the existing private-use exemption, provided all of its conditions are met.
The change does not mean that boat rental is no longer available in Ibiza or Formentera. It changes the requirements for customers who want to take control of a rented vessel themselves.
A significant change for Ibiza's charter industry
The new requirement represents a notable change for the Pitiusan charter market, where small self-drive boats have long formed part of the tourist boating offer.
Companies now have to incorporate qualification checks into their rental procedures and ensure that the person taking responsibility for navigation meets the applicable requirements.
For customers, the key message is simple: from October 1, 2026, the fact that a rental boat is small and low-powered is no longer enough to operate it without a qualification.
Before booking, visitors should check the exact licence requirements for the boat they intend to rent and confirm with the rental company what documentation they will need to provide.
