Ibiza Family Wins Legal Ownership of Home After Living There for More Than 40 Years

October 19, 2026

A family in Ibiza has obtained judicial recognition of ownership of the home where they have lived for more than four decades, following a court decision based on a legal mechanism known as extraordinary acquisitive prescription, or usucapión extraordinaria.

The case, reported on 19 October 2026, concerns a property that remained registered in the name of a construction company despite the family's long-term occupation. According to information provided by the family's lawyers, the court recognised the family as the owners after considering the duration and circumstances of their possession of the property.

The ruling illustrates how Spanish law can, under specific conditions, recognise ownership acquired through prolonged possession. However, the legal requirements are more demanding than simply living in a property for a particular number of years.

How the Family Came to Live in the Property

According to the account provided by the law firm handling the case, the family's occupation began in the 1980s, when an intermediary offered them the home for rent on behalf of the company that owned it.

The arrangement was never formally completed. The intermediary reportedly disappeared before the rental contract could be finalised, and nobody subsequently contacted the family to demand that they leave the property.

The family continued living in the home for more than 40 years, while the company remained listed as its registered owner.

Over that period, the family assumed a range of expenses associated with the property, including property tax (IBI), community fees, extraordinary assessments, waste collection charges and utility bills.

According to the lawyers, these payments formed part of the evidence used to support the family's claim.

What Is Extraordinary Acquisitive Prescription?

Extraordinary acquisitive prescription is a legal mechanism under the Spanish Civil Code that can allow a person to acquire ownership of immovable property through prolonged possession, even without a conventional transfer of ownership.

Article 1959 of the Civil Code establishes a period of 30 years of uninterrupted possession for this form of acquisition. The possession must also satisfy legal conditions, including being exercised as an owner and being public, peaceful and uninterrupted.

The mechanism does not require the same proof of good faith or a valid title as ordinary acquisitive prescription. Nevertheless, a court must assess whether the specific circumstances satisfy the applicable legal requirements.

This distinction is important because long-term occupation alone does not automatically establish ownership. The nature of the possession, its continuity and the available evidence all matter.

Evidence Presented in the Ibiza Case

According to the law firm, the family had occupied the home for more than four decades and had consistently paid expenses associated with its upkeep and use.

The lawyers argued that these payments helped demonstrate that the family's possession had been public and continuous. They also stated that the former owner had not demanded that the family vacate the property or otherwise challenged their continued occupation.

The company registered as the owner had been dissolved and did not appear in the court proceedings, according to the information supplied by the lawyers.

Following the proceedings, Court of Instance of Ibiza, Civil Section, No. 3, recognised the family as the owners of the property.

The full judgment and case number were not available in the reporting reviewed, so the detailed legal reasoning and whether the decision is final could not be independently assessed.

What the Ruling Means

The case demonstrates how extraordinary acquisitive prescription may provide a route to legal ownership in circumstances involving decades of possession and an unresolved property title.

It does not establish a general right for anyone occupying a home for 30 years to become its owner. Each case depends on the legal conditions being met and the evidence presented before the court.

For this Ibiza family, the reported ruling brings formal recognition of ownership after more than 40 years living in a property whose registered ownership had remained unresolved.
